Crime Conviction Notification

II. Purpose

To establish the policy and procedure for certified, accredited or authorized individuals and certification, accreditation or authorization applicants to inform North Coast EMS when convicted of any crime other than a minor traffic violation.

III. Policy

A. All certification, accreditation or authorization applicants are required to inform North Coast EMS if convicted of any crime other than a minor traffic violation, with the initial application.

B. Any individual who is certified, accredited or authorized by North Coast EMS, and/or affiliated with a North Coast EMS provider or hospital in the capacity of a prehospital care volunteer or employee, is required to inform North Coast EMS within thirty (30) days of being convicted of any crime, other than a minor traffic violation, which occurs within his/her two-year certification, accreditation and/or authorization cycle.

C. Failure to report such convictions may result in certification, accreditation and/or authorization denial, suspension or revocation.

IV. Procedure

A. A completed application for certification, accreditation or authorization must be completed and submitted with any documentation requested regarding previous or pending convictions of any crime other than a minor traffic violation..

B. If an individual is convicted of any crime other than a minor traffic violation during his/her certification, accreditation and/or authorization period, (s)he must notify North Coast EMS, in writing, immediately, but no later than thirty (30) days after said conviction.

C. The notification to North Coast EMS must include an explanation letter regarding the conviction(s) in detail, and must include copies of verifying documentation from the court.

D. In the case of a certification, accreditation or authorization applicant who has been convicted of, or has a pending court case regarding, any crime other than a minor traffic violation, and is affiliated with a prehospital care agency who, for employment purposes, has conducted a Department of Justice background check and found applicant hirable, that agency director, owner, or chief may sign a waiver of further background check for the applicant.

E. Applications and documentation will be reviewed and a decision regarding certification, accreditation or authorization will be made by the North Coast EMS Medical Director.

F. Decisions of the North Coast EMS Medical Director regarding certification, accreditation or authorization, or denial, suspension or revocation of certification, accreditation or authorization are final.

V. Reconsideration Process

A. If certification, accreditation or authorization is denied, suspended or revoked by the North Coast EMS Medical Director because of a conviction of a crime, certification, accreditation or authorization applicant may request reconsideration of that decision, in writing, to the North Coast EMS Executive Director.

B. If after the Executive Director makes a decision further reconsideration is requested, the certification, accreditation or authorization applicant may appeal, in writing, to the North Coast EMS Joint Powers Governing Board.

C. If necessary, certification, accreditation or authorization applicant who has requested reconsideration of a prior decision may need to appear and testify in person to either the Executive Director and/or the Joint Powers Governing Board.
